Welcome to Thrive with Marian. These Terms & Conditions govern your use of the Thrive with Marian website and your participation in services, programmes, workshops, events and other offerings provided by Thrive with Marian.
By accessing this website, booking a service or purchasing a programme, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use this website or purchase our services.
1. About Thrive with Marian
Thrive with Marian provides coaching, breathwork, embodiment, movement and wellbeing experiences, including one-to-one sessions, group programmes, workshops, retreats and online programmes.
Thrive with Marian is operated by Marian Ní Chonghaile.
Throughout these Terms & Conditions, “Thrive with Marian”, “we”, “us” and “our” refer to Marian Ní Chonghaile / Thrive with Marian.
“You” and “your” refer to the person accessing the website or participating in our services.
2. Using This Website
You may use this website for lawful and personal purposes.
You agree not to:

use the website in a way that may damage or interfere with its operation;

use the website for unlawful, fraudulent or harmful purposes;

copy, reproduce, republish, sell or commercially exploit material from this website without our written permission;

3. Our Services
The information provided on this website is intended to give a general description of our services and programmes.
While we make every reasonable effort to ensure that information on the website is accurate and up to date, we reserve the right to make reasonable changes to programme content, dates, venues, facilitators or delivery methods where necessary.
Any specific terms relating to a particular programme, workshop, retreat or service will be communicated at the time of booking or purchase.
4. Coaching, Breathwork and Wellbeing Disclaimer
Our services are intended to support personal development, wellbeing, self-awareness and personal growth.
They are not a substitute for medical care, psychological treatment, psychotherapy, counselling or other professional healthcare.
We do not diagnose, treat or cure medical or psychological conditions.
You remain responsible for your own health, wellbeing and decisions while participating in our services.
If you have a medical or psychological condition, are pregnant, are taking medication, or have any concerns about whether breathwork, movement or another practice is appropriate for you, you should seek advice from an appropriate qualified healthcare professional before participating.
You should stop any practice that causes you discomfort, distress, dizziness, pain or other concerning symptoms and seek appropriate professional support where necessary.
5. Breathwork Safety
Some Thrive with Marian sessions include conscious connected breathwork and other breath-based practices.
Breathwork can create strong physical and emotional experiences. You are always invited to participate at your own pace and to respect your own boundaries.
You should disclose any relevant health concerns to Marian before participating where appropriate.
Where a particular breathwork practice may not be suitable for you, you may be asked not to participate or to modify the practice.
Participation in breathwork is voluntary, and you remain responsible for making appropriate choices about your participation.
6. Thrive Within
Thrive Within is a 13-week online embodied transformational programme.
The programme includes live online sessions, recordings, practices, reflection, community connection and a 30-day integration period, as described on the Thrive Within programme page at the time of purchase.
Programme dates, content and delivery may occasionally need to change due to circumstances beyond our reasonable control. Where this happens, we will make reasonable efforts to provide an alternative arrangement.
Access to recordings and programme materials is provided for the participant's personal use and for the duration specified for the programme.
Programme materials must not be copied, shared, reproduced, recorded, resold or distributed to others without written permission.
7. 30-Day Integration
The 30-day integration period is intended to provide space to continue exploring and integrating the practices introduced during the live programme.
It includes self-paced practices and suggestions for continuing breathwork, movement, embodiment, reflection and connection at your own pace.
The integration period is educational and supportive in nature. It does not constitute medical, psychological or therapeutic treatment.
8. Community and WhatsApp
Where a Thrive with Marian programme includes access to a private community or WhatsApp group, participation is subject to respectful community guidelines.
You agree to:

treat other participants with respect;

maintain appropriate confidentiality;

not share another participant's personal information or contributions outside the community;

not use the group for advertising or unsolicited promotion;
-
not engage in abusive, discriminatory, threatening or inappropriate behaviour; and
-
respect the boundaries and privacy of other participants.
We reserve the right to remove a participant from the community where their behaviour is considered inappropriate or harmful to the group.
No refund will necessarily be provided where access is removed because of a serious or repeated breach of community guidelines.
9. Bookings and Payment
Where payment is required for a service or programme, the price displayed at the time of booking or purchase will apply.
Payment must be made through the payment method provided at the time of booking.
Your place on a programme, workshop or event is confirmed once payment has been successfully received, unless otherwise stated.
Prices may change from time to time. Any price change will not affect a purchase that has already been confirmed.
10. Cancellations and Refunds
Cancellation and refund terms may vary depending on the service or programme purchased.
Where a specific cancellation or refund policy is provided at the time of booking or purchase, that policy will apply.
Nothing in these Terms & Conditions is intended to remove or restrict any rights you may have under applicable Irish or EU consumer protection law.
Where you are entitled to a refund under applicable law, we will provide the refund in accordance with those legal requirements.
For digital content or online programmes, where applicable, you may be asked to expressly acknowledge that access to digital content may begin immediately and that this may affect statutory cancellation rights. Any such arrangements will be communicated clearly at the point of purchase.
11. Missed Sessions
If you are unable to attend a live online session, recordings will be provided where recordings form part of the programme.
Missing a live session does not normally entitle you to a refund or reduction in the programme fee.
Where a session cannot take place due to circumstances on our side, we will make reasonable efforts to provide an alternative date, recording or other appropriate arrangement.
12. Events and Retreats
For in-person workshops, retreats and events, additional information may be provided at the time of booking, including venue details, arrival information, cancellation arrangements and any specific health or safety requirements.
Participants are responsible for following reasonable instructions provided by the facilitator, venue or event organiser.
Where accommodation, travel or other third-party services are included or recommended, those services may be subject to the terms and conditions of the relevant provider.
13. Intellectual Property
Unless otherwise stated, all content created by Thrive with Marian remains our intellectual property.
This includes, but is not limited to:

programme materials;

workbooks and journals;

written content;
-
exercises and practices;
-
recordings;
-
website content;
-
photographs and graphics;
-
logos and branding; and
-
original programme concepts and resources.
You may use materials provided to you for your own personal use.
You may not reproduce, distribute, publish, sell, licence, teach, adapt or commercially exploit our materials without our prior written permission.
14. Testimonials and Participant Contributions
Where you voluntarily provide a testimonial, feedback, photograph or other contribution for use in our marketing, we will only use it in accordance with the permission you have given.
You should not share personal or confidential information about another participant without their permission.
15. Privacy and Cookies
Your privacy is important to us.
Our Privacy Policy explains how we collect, use, store and protect personal information.
